Update TaskForce AI: Protecting Creators and Promoting Fair AI Development

The pace of developments in artificial intelligence is accelerating rapidly. At BumaStemra, we remain committed to ensuring that AI is used in a fair and responsible manner. In recent months, we have taken significant steps to protect creators’ rights and contribute to the dialogue at both the European and national levels.

Supporting an International Statement on Authors’ Rights in the Age of AI
BumaStemra has endorsed an international statement, joining forces with other organisations to call for fair and transparent regulations around AI. This statement highlights the urgent need for clear and binding measures to ensure that the advancement of AI does not come at the expense of creators and other rights holders.

A Call to Dutch Policymakers: The AI Code of Practice Must Be Improved
In addition to our international involvement, we have also issued a formal appeal to the relevant ministries in the Netherlands and to Dutch representatives in Brussels working on this matter. In a letter, we raised concerns about the third draft version of the General-Purpose AI Code of Practice, currently being prepared by the European Commission as part of the AI Act (EU 2024/1689).

While the Code of Practice aims to support AI providers in complying with the AI Act, the current draft falls short when it comes to safeguarding authors’ rights. In our letter, we stress that:

  • Legal obligations for AI providers must be clearer and more robust.

  • Creators must retain the ability to protect their works.

  • Transparency regarding the datasets used is essential.

  • An accessible and effective complaints mechanism is necessary.

We continue to actively advocate for balanced AI legislation—where innovation and protection go hand in hand.

Working Towards Future-Proof AI Legislation
AI offers tremendous opportunities, but it is crucial that the rights of creators and rights holders remain firmly protected. Through our TaskForce AI, we are closely monitoring these developments and actively engaging in discussions at both the national and international levels.
