When BumaStemra processes your personal data

BumaStemra represents over 38,000 composers, songwriters and music publishers. BumaStemra makes sure that they receive fair payment when their creations are used. BumaStemra collects fees worldwide for its members through international sister societies. BumaStemra also licenses global repertoire for use in the Netherlands and collects payment for music use on behalf of international composers, songwriters and publishers and pays it to sister societies.

BumaStemra processes personal data to enter into and implement agreements with members (composers, songwriters and music publishers), music users and other parties, and for providing related services. This involves the exploitation of copyrights, including:
registering client relationship data to ensure the execution of the agreement, maintaining financial records, processing incoming and outgoing payments, complying with legal obligations, and handling queries and incidents.

BumaStemra limits the data collected to that which is necessary to enter into an agreement with BumaStemra as a rightsholder, music user or supplier. Personal data sent by email, post, BumaStemra’s website or apps or by other means of communication (electronic or otherwise) will only be kept for as long as it is necessary to fulfil the agreement in question, for the provision of the service in question or for as long as legally required.

Who BumaStemra shares your personal data with

BumaStemra may share your personal data with sister societies, clients and suppliers (e.g. data processors) who provide services or carry out work on its behalf, and government bodies. And in all other cases where required to do so, for example by a court order or ruling.

Your personal data may be passed on to suppliers who process data on behalf of BumaStemra outside the European Union. BumaStemra has taken the necessary measures to ensure that these processors have appropriate safeguards in place when processing your personal data. When requested, BumaStemra will notify you of the action taken.

Inspection

You can request to see the relevant personal data processed by BumaStemra (in accordance with Article 15 of the General Data Protection Regulation). If the information provided by BumaStemra in response to your request contains errors or does not serve BumaStemra’s purpose, you may ask BumaStemra to correct, amend or delete the data, to temporarily suspend processing (subject to conditions), or to transfer it to you in a commonly used electronic format.

Cookies

On the www.bumastemra.nl website and the accessible portals, cookies are used to ensure that the website and portals work correctly (‘functional cookies’) and to collect anonymised data about how the website is used (‘analytic cookies’).
Before cookies are placed on your computer, tablet or phone for other purposes, BumaStemra requests permission through a pop-up or banner on the website.

Complaints

If you feel that BumaStemra is not complying correctly with the legislation relating to the protection of your personal data, you can file a complaint with BumaStemra’s Privacy Officer by post or by email (privacy.officer@bumastemra.nl). You can also file a complaint with the Dutch Data Protection Authority at any time – before, during or after the above complaint process (www.autoriteitpersoonsgegevens.nl).
